Withdrawal from the Jinkee Loan contract
If, after taking any of the loans, we decide to cancel the signed contract and return the entire borrowed amount, it is worth using the legal provisions contained in the Consumer Credit Act of 12 May 2011, which regulate the activities of non-bank loan companies in Poland.
Art. 53. 1. The consumer has the right, without giving any reason, to withdraw from the consumer credit agreement within 14 days from the date of the contract.
How to withdraw from a Jinkee Loan loan agreement ?
As we can read in article 53.1 above. each borrower has the right to withdraw from the loan agreement without giving a reason within 14 days from the date of its conclusion. These deadlines apply to all borrowers, even those who have used the services of Jinkee Loan. In the event of such withdrawal being made within the deadline, the loan agreement will be deemed null and void.
Withdrawal from the loan agreement with Jinkee Loan takes place by sending the lender the appropriate document containing a statement of withdrawal. Jinkee Loan provides online loans and therefore a template for such a statement should be on the lender’s website. Termination of the Jinkee Loan contract
As a borrower, we can terminate the contract with Jinkee Loan at any time, without additional charges, by giving 30 days’ notice by sending a notice of termination to the company’s correspondence address indicated in the contract or to the e-mail address. Along with sending the notice, we are obliged to repay the entire loan debt, including fees and commissions due, before the notice period expires.
On the other hand, the lender, i.e. in this case Jinkee Loan, has the right to terminate the contract with two months’ notice. However, if in the loan application it turns out that we intentionally provided false information or information that misled the lender, in this case Jinkee Loan has the right to terminate the contract with immediate effect. Termination of the contract by the lender for the reasons set out above also involves the need to repay the loan in full.
Withdrawal from the Jinkee Loan contract – consequences
In the event of withdrawal from the loan agreement, we are obliged to immediately return the entire amount borrowed to Jinkee Loan’s bank account, together with interest specified in the agreement for the period from the day the loan is paid to our account until the day it is repaid. The refund of the entire sum of money should be made no later than within 30 days from the date of submission of the statement of withdrawal from the contract. It is worth knowing that the loan repayment day is the day the money is transferred.
When we exceed the contractual deadline of 30 days, we will accrue interest for delay, in the amount of twice the statutory interest for delay, which is the sum of the reference rate of the National Bank of Poland and 5.5 percentage points.
Withdrawal from the Jinkee Loan contract – how to deliver the letter?
To meet the withdrawal deadline (14 days), an appropriate statement of withdrawal from the contract should be submitted to the lender before its expiry. The model declaration of withdrawal is attached as Annex 2 to the loan framework agreement. We can also find it on the official Jinkee Loan homepage in the bottom tab called “General conditions”.
The completed and signed declaration of withdrawal should be sent to the Jinkee Loan correspondence address or e-mail address.
